1. Acceptance of Terms

By downloading, installing, accessing, or using the Stamp Identifier mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Viksva, MB, a company registered in Vilnius, Lithuania ("Company," "we," "our," or "us").

Age: You must be at least 16 years old (or the age of digital consent in your country, if lower) to use the App. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. Subscriptions may only be purchased by adults or with a parent's or guardian's consent.

2. Description of Service

Stamp Identifier is a mobile application that uses Google Gemini artificial intelligence to analyze images of stamps and provide identification, condition grading, and approximate valuations. The App provides:

• Stamp identification through AI-powered image analysis using Google Gemini AI models
• Condition assessment and grading based on visual analysis
• Approximate value estimation based on identified characteristics
• Support for multiple collectible types: stamps, coins, banknotes, and antiques
• Two-sided capture (front and back) for comprehensive analysis
• Collection history and management
• Basic features for free users with daily usage limits
• Premium subscription tiers with enhanced features and unlimited usage

3. Subscription Plans and Billing

3.1 Available Subscription Tiers

We offer the following subscription plans:

• Weekly Subscription: Includes a 3-day free trial period, after which you will be charged for weekly access to premium features
• Yearly Subscription: Annual access to premium features with immediate billing upon subscription

3.2 Free Trial Terms

• The weekly subscription includes a 3-day free trial that begins immediately upon subscription
• You will have full access to premium features during the trial period
• Your payment method will be charged automatically when the trial period expires unless you cancel before the trial ends
• The yearly subscription does not include a free trial period and billing begins immediately

• All payments are processed through your device's app store (Apple App Store or Google Play Store)
• Payment will be charged to your app store account upon confirmation of purchase or after the free trial period expires
• Subscription management, including billing, is handled by the respective app store

4. Subscription Management and Cancellation

4.1 How to Cancel Your Subscription

For iOS (Apple App Store):

1. Open the Settings app on your iOS device
2. Tap your Apple ID at the top of the screen
3. Tap "Subscriptions"
4. Find "Stamp Identifier" and tap it
5. Tap "Cancel Subscription"

For Android (Google Play Store):

1. Open the Google Play Store app
2. Tap the profile icon in the top right
3. Tap "Payments & subscriptions" → "Subscriptions"
4. Find "Stamp Identifier" and tap it
5. Tap "Cancel subscription"

4.2 Effect of Cancellation

• You may cancel your subscription at any time before the next billing cycle
• Cancellation must be done through your app store account, not through the App itself
• After cancellation, you will retain access to premium features until the end of your current billing period
• Once your current billing period expires, you will lose access to premium features but can continue using basic free features
• Your account data and collection history will be preserved

5. User Responsibilities and Prohibited Uses

5.1 Acceptable Use

You agree to use the App only for lawful, educational, and entertainment purposes and in accordance with these Terms. You are responsible for:

• Maintaining the security of your device
• Ensuring you have the right to submit any images or content for analysis
• Using the service in compliance with all applicable laws and regulations
• Understanding that all identifications and valuations are approximate and for educational/entertainment purposes only
• NOT relying on the app for commercial, insurance, legal, or professional valuations
• Consulting professional philatelic experts for any important valuations or authentications
• Verifying all identifications with proper expert resources when accuracy matters
• Understanding that AI-based identifications can be significantly inaccurate
• Not using the app for insurance claims, estate valuations, or legal purposes without professional verification

5.2 Prohibited Activities

You may not:

• Use the App for any illegal or unauthorized purpose
• Reverse engineer, decompile, or disassemble the App
• Share your subscription access with others
• Submit content that violates intellectual property rights
• Attempt to circumvent usage limitations or technical measures
• Use the App in a way that could damage or impair our services
• Submit inappropriate, offensive, or harmful content
• Use the App for commercial purposes without our written permission
• Attempt to gain unauthorized access to our systems or other users' data

5.3 Your Responsibility for Valuation, Purchase and Sale Decisions

5.4 Business Users

If you use the App in the course of a trade, business, craft, or profession — including as a dealer, auctioneer, appraiser, or insurer — you are not a consumer, the consumer protections referred to in Section 10.3 do not apply to you, and the disclaimers and limitations in Sections 10.1 and 10.2 apply to you in full. You are additionally responsible for ensuring that any use of the App's output in your own professional services complies with the standards and regulations applicable to your profession, and you must not represent the App's output as your own professional opinion.

6. Privacy and Data Collection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

7. Intellectual Property

The App and all its content, features, and functionality are owned by Viksva, MB and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App solely for your personal, non-commercial use.

7.1 Optional private contributions

If you explicitly enable "Contribute scan photos," you confirm that you own the submitted image or have permission to provide it. You grant Viksva, MB a non-exclusive, worldwide, royalty-free licence to store, copy, re-encode, crop, analyse, annotate, compare, and create private technical derivatives from that contribution solely to build, evaluate, and improve the private stamp identification reference database. This licence ends when the contribution is deleted, except for short-lived backups and a pseudonymous deletion receipt retained as described in the Privacy Policy.

This contribution licence does not permit us to display the image publicly, include it in a public catalog, sell it, or license it to unrelated third parties. Public display is governed only by the separate, optional "Allow catalog publication" choice in the app and the Catalog Display Licence (version catalog-licence-v1), which you may withdraw at any time in Settings; nothing is published without it, and never without our review. Identification reports and corrections are treated as factual feedback; we may use verified, anonymized factual corrections to improve canonical stamp data while preserving provenance and revision history.

8. Third-Party Services and AI Limitations

The App integrates with third-party services including but not limited to:

• Google Gemini AI for image analysis and stamp identification processing
• RevenueCat for subscription management
• Apple App Store and Google Play Store for payment processing
• Analytics services for app improvement
• eBay Browse API for the optional "Live on eBay" listings card (current listings for the identified stamp; we receive no commission and are not a party to any eBay transaction)

These third parties have their own terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.

9. Service Availability and Modifications

• We strive to provide continuous service but cannot guarantee uninterrupted availability
• We reserve the right to modify, suspend, or discontinue the App or any features at any time
• We may update the App to improve functionality, security, or compliance
• Critical updates may be required for continued service access

10. Disclaimers and Limitation of Liability

10.3 Liability That Cannot Be Excluded

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and for gross negligence or intentional misconduct. If you are a consumer resident in the European Union, the EEA, or the United Kingdom, your mandatory statutory rights — including your statutory rights in respect of digital content that is not as described — are unaffected, and the disclaimers and limitations in Sections 10.1 and 10.2 apply only to the extent permitted by the consumer law of your country of residence.

We may terminate or suspend your access to the App immediately, without prior notice, for any reason including violation of these Terms. Upon termination:

• Your right to use the App ceases immediately
• You remain liable for all charges incurred prior to termination
• Subscription billing continues until cancelled through your app store account
• Provisions regarding liability, indemnification, and governing law survive termination

13. Governing Law and Dispute Resolution

• These Terms are governed by the laws of Lithuania
• Any disputes shall be resolved exclusively in the courts of Lithuania
• You consent to the jurisdiction of Lithuanian courts
• If any provision of these Terms is found unenforceable, the remaining provisions remain in effect

Consumers in the EU/EEA and elsewhere: nothing in these Terms limits any rights you have under mandatory consumer-protection law that cannot be waived by agreement. In particular, if you are a consumer resident in the EU/EEA you may also bring proceedings in the courts of your country of residence, and you retain the protection of that country's mandatory rules; the 14-day right of withdrawal for digital content is exercised through the app store you purchased from (see Section 4). Nothing in Sections 8, 10 or 11 excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for intent or gross negligence, or for anything else that cannot be excluded or limited by applicable law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Providing in-app notification for significant changes

Continued use of the App after changes constitutes acceptance of the updated Terms.

15. App Store Specific Terms

15.1 Apple App Store Additional Terms

For users who download the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Viksva, MB only, not with Apple Inc.
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support services for the App
• All payments and refunds are handled exclusively by Apple in accordance with Apple's policies
• Apple is a third-party beneficiary of these Terms and may enforce them against you
• Apple is not responsible for any consequences resulting from identifications, valuations, or your use of the App

15.2 Google Play Store Additional Terms

For users who download the App from Google Play Store, the following additional terms apply:

• These Terms are between you and Viksva, MB only, not with Google LLC
• Google is not responsible for the App or its content
• Google has no obligation to provide support services for the App
• All payments and refunds are handled exclusively by Google in accordance with Google Play's policies
• Google is not responsible for any consequences resulting from identifications, valuations, or your use of the App

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Viksva, MB regarding the use of the App and supersede all prior agreements and understandings.
